Terms & Conditions

These Terms govern both this website and the paid MedAmend subscription service. Please read them carefully, including the automatic-renewal and cancellation terms in Sections 5 and 6.
1. Agreement to these Terms
These Terms & Conditions (the “Terms”) are a binding agreement between you and MedAmend (“MedAmend,” “we,” “us,” or “our”). They govern your access to and use of this website and of the MedAmend subscription service and related applications, features, and content (together, the “Service”).
By accessing the website, creating an account, or subscribing to the Service, you agree to these Terms and to our Privacy Policy, Cookies Policy, Disclaimer, and Refund Policy, each of which is incorporated by reference. If you do not agree, do not use the Service.
2. Who may use the Service
The Service is intended for residents of the United States only. It is not directed to, and should not be relied on by, individuals located outside the United States.
You must be at least 18 years old and able to form a legally binding contract to create an account or subscribe. By using the Service you represent that you meet these requirements and that the information you provide is accurate.
3. Your account
Some features require an account. You are responsible for the information you provide, for keeping your login credentials confidential, and for all activity that occurs under your account. Notify us promptly at the contact address below if you believe your account has been accessed without your authorization.
4. What MedAmend is — and is not
MedAmend provides financial and administrative tools to help you understand, organize, and manage healthcare costs — for example, reviewing medical bills, explanations of benefits, and insurance information.
MedAmend does not provide medical, legal, financial, tax, or insurance advice, and it does not act as your attorney, broker, or representative. Using the Service does not create a doctor-patient, attorney-client, or fiduciary relationship. We do not guarantee any particular outcome, including any specific reduction in or recovery of charges. 5. Subscriptions, billing, and automatic renewal
The Service is offered on a paid subscription basis. We may offer monthly and/or annual plans. There is no free trial. By subscribing, you authorize us and our payment processor to charge the payment method you provide for the plan you select, plus any applicable taxes.
IMPORTANT — AUTOMATIC RENEWAL: Your subscription renews automatically at the end of each billing period (each month for monthly plans, each year for annual plans) at the then-current price, and your payment method is charged automatically, until you cancel. You will continue to be charged on a recurring basis unless and until you cancel as described in Section 6.
We process payments through Stripe. We do not store your full payment card number; it is handled by our payment processor under its own terms. If a charge fails, we may retry it and may suspend or terminate your subscription.
If we change subscription prices, we will give you advance notice as required by applicable law, and any change will take effect at your next renewal. Continuing to use the Service after a price change takes effect means you accept the new price; if you do not agree, you may cancel before the change takes effect.
6. Cancellation
You may cancel your subscription at any time through your account settings or by contacting us at the address below. Cancellation stops the next automatic renewal.
When you cancel, you keep access to the paid features through the end of your current billing period, and your subscription will not renew after that. We do not provide refunds for amounts already paid, including for the unused portion of a billing period. See our Refund Policy for full details and any rights you may have under applicable law.
7. Your information and protected health information (PHI)
To use the Service you may provide information that includes protected health information — such as medical bills, explanations of benefits, summaries of benefits and coverage, and insurance or claims records. You grant us the right to process this information solely to provide and improve the Service for you, as described in our Privacy Policy.
We handle this information in accordance with applicable law, including the Health Insurance Portability and Accountability Act (HIPAA) where it applies. We do not sell your personal information or your health information, and we do not use it for advertising. No health information is shared with our analytics provider, and no health information is sent to our payment processor.
8. Acceptable use
When using the Service, you agree not to:
- use the Service for any unlawful purpose or in violation of these Terms;
- submit another person’s information without authorization;
- attempt to access accounts, data, or systems that are not yours;
- probe, scan, disrupt, or test the vulnerability of the Service, or circumvent its security or rate limits;
- scrape, harvest, or bulk-extract content or data from the Service through automated means; or
- interfere with the proper working of the Service or impose an unreasonable load on our infrastructure.
9. Intellectual property
The MedAmend name, logo, software, and the content we provide through the Service are owned by MedAmend or its licensors and are protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your own personal, non-commercial purposes, subject to these Terms. You retain ownership of the information you submit.
10. Third-party services
The Service relies on third-party providers, including cloud hosting and a payment processor, and may link to third-party websites. We are not responsible for the content, policies, or practices of third parties. Your use of a third-party service is governed by that provider’s own terms.
11. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, TO THE FULLEST EXTENT PERMITTED BY LAW. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that any information it provides is complete or accurate. See our Disclaimer for more.
12. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, MEDAMEND WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you, and nothing in these Terms limits liability that cannot be limited by law.
13. Indemnification
You agree to indemnify and hold MedAmend harmless from any claims, losses, and expenses (including reasonable legal fees) arising out of your misuse of the Service or your violation of these Terms or of applicable law.
14. Suspension and termination
We may suspend or terminate your access to the Service if you violate these Terms, if required by law, or to protect the Service or other users. You may stop using the Service at any time. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and indemnification — will survive.
15. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the effective date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect means you accept the updated Terms.
16. Governing law and disputes
These Terms are governed by the laws of the State of [GOVERNING-LAW STATE], without regard to its conflict-of-laws rules, and by applicable U.S. federal law. You agree that the state and federal courts located in [GOVERNING-LAW STATE] will have jurisdiction over any dispute that is not otherwise resolved, except where applicable law provides otherwise.
